TERMS AND CONDITIONS OF HIRE

Short-Term Accommodation Booking Agreement

These Terms and Conditions of Hire form a legal agreement between the accommodation provider (referred to as **"we", "us", "our", or the "Owner"**) and you, the person making the booking and all adult members of your party staying in our properties (**"you", "your", or "Guest"**).

By making a booking or staying in one of our properties, you accept and agree to be bound by these terms and conditions. These terms apply to all bookings made via eviivo and other online travel agents (OTAs). Your Booking Confirmation email will specify the property address, check-in and check-out times, and all charges applicable to your booking.

The Guest making the booking is responsible for all persons included in that booking and must ensure that all party members are aware of and comply with these Terms & Conditions. The Owner reserves the right to decline any booking or refuse access to any guest or person accompanying a guest who has not complied with these Terms & Conditions.

1. SCOPE OF HIRE

1.1 Non-Tenancy

Your stay with us is not intended to confer exclusive possession, nor to create a landlord and tenant relationship. This is a “short-term licence to occupy” for holiday or temporary accommodation purposes only. You will not be entitled to any rights under any statutory provision relating to residential tenancies, including (without limitation) the Rent Act 1977, the Housing Act 1988, or any similar or successor legislation. Nothing in these terms gives you a tenancy or any right of occupation beyond the dates of your confirmed booking.

1.2 Rates and VAT

Our rates are subject to change without notice unless otherwise agreed by us in writing. VAT may be applicable at the appropriate rate and will be shown in your Booking Confirmation should it apply.

2. AGREEMENT FOR OCCUPATION

2.1 Permitted Occupancy

We permit you to occupy the property for the agreed hire period only and subject to these Terms and Conditions, such occupation being by you personally and only such guests named in your booking. The actions and omissions of any visitor to the property are your responsibility.

2.2 Age Requirement

You must be 18 years or over when you book accommodation with us.

2.3 Booking Acceptance

We reserve the right to refuse to accept any booking for whatever reason. We accept your booking when we issue our Booking Confirmation email.

2.4 Check-In and Check-Out

• Check-in: You may arrive at your accommodation after 3:00 PM (except if stated differently in your Booking Confirmation) on the start day of your booking.
• Check-out: You must leave by 10:30 AM on the last day of your booking.
• No-show: If you fail to arrive by midnight on the first day and do not advise us of a late arrival, we may treat the booking as cancelled by you and charge accordingly.

2.5 Extending Your Stay

If you want to increase your length of stay, we will do our best, subject to availability, to find suitable accommodation for you. However, this may not always be possible.

2.6 Occupancy Limits

The number of people occupying the property must not exceed the maximum number of permitted occupants shown in your booking. Over-occupancy is a serious breach of these terms and will result in immediate termination of your stay without refund and/or Additional Charges.

3. PAYMENT, DEPOSITS AND CHARGES

3.1 Payment Terms

To secure your booking, payment must be received by us in cleared funds:

- At the time and in the amount specified in your Booking Confirmation
- Payment may be due at booking, a specified number of days before arrival, or on arrival
- A booking fee (if applicable) will be shown on your Booking Confirmation
- Should payment not reach us by the due date, we reserve the right to cancel the booking and any deposit paid may be forfeited

3.2 Late Payment Interest

If you fail to pay any sum due under this agreement when due, you will pay us interest on demand at:
- The rate under the Late Payment of Commercial Debts (Interest) Act 1998 (if you are a business), or
- 4% above the Bank of England base rate (if you are a consumer)

Interest accrues daily from the due date until we receive full payment in cleared funds.

3.3 Departure Condition

We expect the property to be left in a reasonable state on departure, including:

- Rubbish placed in rubbish bins

- Soiled dishes placed in the dishwasher or sink

If additional cleaning is required at our discretion, the cost will be charged as an Additional Charge.

3.4 Security Deposit

A security deposit may be taken at or prior to check-in to cover your obligations under this Agreement. This may be:

- A direct payment, or
- An authorisation to debit your credit or debit card used for the booking

Any security deposit will be returned in full (or payment authorisation cancelled) when you return the property in accordance with these terms. Where you are liable for loss, damage or other Additional Charges, we may withhold some or all of your deposit to cover these and our reasonable administration fees.

3.5 Card Pre-Authorisation for Additional Charges

Where Additional Charges (including damage, excess cleaning, late checkout, utilities overage, or other charges) are payable, you hereby authorise us to debit them from the credit or debit card used to make the booking, up to a pre-authorised amount (typically £250) as shown in your Booking Confirmation.

Our card hold will normally last up to 5 days from departure. Where Additional Charges exceed the pre-authorised amount, you will be invoiced for the excess. If no card was used in the booking, you must pay Additional Charges by another means acceptable to us. All Additional Charges are due on or shortly after check-out unless otherwise stated.

3.6 Late Payment of Additional Charges

If you fail to pay any Additional Charge within 14 days of our invoice, you will incur an administration fee of £50 to cover collection costs.

4. HOUSE RULES AND GUEST CONDUCT

4.1 Smoking and Vaping

- UK legislation provides that smoking is not permitted in serviced accommodation
- Smoking is not permitted inside the property at any time
- Smokers must leave the building if they wish to smoke outside
- Evidence of smoking or vaping inside the property will incur a specialist cleaning fee (typically £250) as an Additional Charge

4.2 Illegal Substances

Anyone found using or under the influence of illegal drugs or substances classified under the Misuse of Drugs Act 1971 will be:

- Reported to the police immediately
- Asked to leave the premises
- Subject to forfeiture of all payment without refund

4.3 Noise and Quiet Hours

- Guests must not cause nuisance or annoyance to the Owner, staff, neighbours or other guests
- Quiet hours: 11:00 PM to 7:00 AM excessive noise during this period can be reported to the local Council
- Parties and large gatherings are not permitted without prior written consent
- Breach of this rule may result in immediate termination and removal from the property

4.4 Behaviour and Respect

Guests must not:

- Behave in an abusive, threatening or violent manner toward our staff, contractors or neighbours
- Undertake any illegal or immoral activities
- Display aggressive or threatening behaviour

Serious or repeated breaches may result in immediate removal and loss of all payment without refund.

4.5 Pets

- Pets are not permitted at some of our properties unless expressly agreed in writing before arrival
- Where approved, a Pet Addendum must be signed and a per-pet per-night fee (typically £20) will apply
- Full pet conditions are set out in the attached Pet Addendum

4.6 Housekeeping and Linen Service

- No daily housekeeping service is provided unless stated in your Booking Confirmation
- Linens and bath towels are included; daily maid service is not
- Additional cleaning and linen changes are available as an Additional Charge
- Towels or linens provided must not be removed from the property

5. CHANGES TO YOUR BOOKING

5.1 Changes or Cancellations by You

We will use reasonable endeavours to accommodate requests for alterations, subject to availability.

5.2 Cancellation Policy

Your right to cancel and any charges depend on the rate and cancellation policy you selected at booking, clearly shown on your Booking Confirmation (e.g., "Flexible", "Semi-Flexible" or "Non-Refundable").

- Cancellations more than 30 days before arrival: No cancellation fee; deposit normally refunded
- Cancellations within 30 days of arrival: Subject to your selected rate policy and may result in loss of payment
- No-shows: Treated as a cancellation and charged in accordance with your booking rate policy (may be up to 100% of total booking value)
- Early departures or reduced guests: No refund for unused nights or reduced occupancy

5.3 Travel Insurance

We strongly recommend you purchase appropriate travel insurance to cover unforeseen changes to your plans.

5.4 Changes or Cancellations by Us

If we must cancel or significantly change your accommodation, we will:

- Use all reasonable efforts to contact you as soon as possible
- Offer suitable alternatives if available
- Refund any money paid in respect of unused nights within 14 days if alternatives are unacceptable

5.5 Force Majeure

We are not liable for changes, cancellations or other effects on your booking due to events beyond our reasonable control (force majeure), including:
- Terrorist activity, industrial disputes, natural or man-made disasters
- Fire, epidemic, pandemic, adverse weather
- Other unforeseeable circumstances

Where a force majeure event occurs, we will act reasonably and in accordance with applicable consumer protection rules and/or OTA policies.

6. LOSS, DAMAGE AND YOUR PROPERTY

6.1 Check-In Inspection

Please inspect the property on arrival. Unless you notify us of defects or damage within 2 hours of check-in, we will assume you have accepted that the property is in good repair, clean and tidy, and you waive any right to claim otherwise.

6.2 Risk and Liability for Damage

- Risk of damage passes to you on check-in and remains with you until the property is returned to us
- You are liable for all loss or damage (except fair wear and tear) caused during your stay
- You are also liable for any reasonable loss of rental resulting from such loss or damage

6.3 Personal Property

You must take all necessary steps to safeguard your personal property. We accept no liability for damage to or loss of your property unless caused by our negligence. This includes:

- Cars and contents: Parked at owner's risk; ensure vehicles are locked and possessions left out of sight
- Property left behind: Kept for up to one week after departure or forwarded at your expense, at our discretion
- Valuables: Must not be left in view of third parties or in common areas

6.4 Electrical Appliances

Any guest using personal electrical appliances (hairdryers, straighteners, shavers, computers, etc.) must:

- Use the appropriate adaptor - Non-UK plugs used without adaptors are a serious fire risk
- Ensure all heated appliances are switched off and stored safely before leaving
- Guests in breach of this rule may be asked to leave immediately

7. KEYS AND ACCESS

7.1 Issue of Keys

Unless otherwise agreed, we will issue one set of keys or access devices to the property. If lost, guests must notify us immediately. We may instruct a locksmith or arrange replacements and charge you as an Additional Charge.

7.2 Lockout Assistance

If you lock yourself out and require our assistance to re-enter, we reserve the right to charge a reasonable call-out and administration fee as an Additional Charge.

7.3 Owner Access

We retain keys and access rights to the property and reserve the right to enter at any reasonable time during your stay for:

- Providing services and carrying out necessary maintenance
- Safety checks and inspections
- Essential maintenance or emergency situations

We will make reasonable efforts to contact you before entering, except in an emergency.

7.4 Check-Out and Return

- On check-out, the property must be left locked
- All keys and access devices must be returned as instructed
- Loss of keys/access devices will incur an Additional Charge

7.5 Security

You must:

- Keep the property locked whenever you are not in it
- Guard keys and access devices against loss or theft at all times
- Ensure all door and window locks are properly engaged
- Close all windows when not in the property or during bad weather

7.6 Locks and Duplicates

You must not:

- Change any lock to the property
- Have any duplicate keys or access devices made

8. UTILITIES, INTERNET AND SERVICES

8.1 Utilities and Fair Usage Policy

Utilities (electricity, water, gas and internet, where provided) are included in the rental tariff subject to a “fair usage policy”. You agree to use utilities responsibly:

- Do not leave heating on with windows open or leave it at all times.
- Do not charge non-domestic or high-consumption equipment
- Do not use significantly more than is reasonable for the property size and stay length.

Utilities (including electricity, gas and water) are included in your stay up to a fixed allowance paid by the Owner to the utility provider. This allowance is subject to a fair usage policy. Where actual consumption during your stay exceeds this allowance, any surplus usage will be treated as excessive and the cost of such excess will be invoiced to you as an Additional Charge.

8.2 Broadband Internet

Wireless and/or wired broadband internet may be available at our properties. However:
- We will use reasonable endeavours to provide this service but cannot guarantee uninterrupted or fault-free service
- No minimum speed is guaranteed
- No technical support service is available
- Internet access is not a contractual provision

We do not assume responsibility for:
- Damage to your devices or data
- Security of data transmitted over the internet

You are responsible for:
- Protecting your devices and data
- Using the service lawfully and reasonably
- Restricting usage to normal amounts
- Not using the service for unlawful or offensive purposes

8.3 Service Interruptions

Save where there is a total failure to provide useful accommodation as reasonably expected:
- We cannot be held responsible for failures or interruptions to services (gas, water, electricity, broadband)
- We cannot be held responsible for damage, disturbance or noise from maintenance work in any part of the building or by third parties
- We will act reasonably to liaise with relevant providers and restore services within our control as soon as practicable

9. MAINTENANCE AND REPAIRS

9.1 Reporting Issues

You must notify us as soon as practicable of:
- Any plumbing, electrical or general problems
- Any damage to the property or its contents

You must desist from attempting to remedy such problems on your own.

9.2 Maintenance Call-Outs

If you report a fault and inspection shows the appliance or system was not faulty but was being misused (and usage instructions were provided), we reserve the right to charge you for the maintenance call-out as an Additional Charge.

9.3 Prohibited Activities

You must not:
- Make any alterations to the property
- Attempt any repairs yourself
- Install portable cooking appliances, camping stoves or similar items
- Block or misuse drains, toilets, sinks or pipes
- Put noxious or damaging substances into plumbing

9.4 Condensation and Damp Prevention

You must take all reasonable precautions to prevent condensation and damp by:
- Keeping the property adequately ventilated
- Keeping the property adequately heated
- Using extractor fans in bathrooms and en-suites as directed

10. LIABILITY AND LIMITATIONS

10.1 Death and Personal Injury

We shall have no liability for death or personal injury to you or your party unless it results from our act or omission.

10.2 Limitation of Liability

We shall have no liability for any loss that was not foreseeable when this Agreement was made, or losses not caused by our breach. If you are entering this Agreement in the course of business, we shall have no liability for:
- Loss of profit, goodwill or business
- Increased costs, loss of anticipated savings
- Any special, indirect or consequential loss (whether from breach of contract, negligence or statutory duty)

Our total liability to you is limited to the total cost of your reservation.

10.3 Descriptions and Photographs

All descriptions and photographs of the property are for illustration only. Although we use reasonable endeavours to ensure accuracy, we do not warrant that they are complete or free from minor differences.

10.4 Statutory Rights

We do not exclude liability for fraud. Your legal rights are not affected by any term in this Agreement.

11. TERMINATION OF BOOKING

11.1 Immediate Termination by Us

We may end this agreement immediately if:

- The accommodation fee is not paid on the payment date, or
- You are in serious breach of any term or condition, including (without limitation):
- Over-occupancy
- Smoking or vaping inside
- Property damage
- Creating a nuisance
- Illegal activities
- Abusive or threatening behaviour

11.2 Termination for Operational Reasons

We may also terminate this agreement before or during your stay for safety, security, essential maintenance or other operational reasons. In such cases, and provided you are not at fault, we will refund you for unused nights or use reasonable endeavours to offer suitable alternative accommodation.

11.3 Bankruptcy

We may terminate this agreement if you become bankrupt, have an administration order made against you, or have a judgment enforced against you.

11.4 Vacant Possession

On termination, you must promptly vacate the property and return all keys and access devices to us.

12. GUEST OBLIGATIONS AND CONDUCT

12.1 You Agree To:

- Keep the property, furniture, furnishings and equipment in good and clean condition
- Not make any alterations or attempt repairs
- Immediately report any damage, defect or issue
- Use all equipment strictly in accordance with operating instructions
- Not block or misuse drains, toilets, sinks or pipes; report blockages immediately
- Keep doors and windows secure when unattended and during bad weather
- Take reasonable steps to prevent condensation and damp
- Not store valuables in view of third parties or common areas
- Allow us or our representatives reasonable access for inspection and maintenance
- Not assign, underlet, sub-license or part with possession of the property
- Not sell, loan or dispose of any property contents, including furniture and effects
- Not hang flower pots, clothes or other articles on the outside of the property
- Not do anything that would make any insurance policy void or voidable or increase the premium
- Maintain proper insurance for all your personal property at full replacement value
- Not use the property for any business, commercial or party use unless expressly agreed in writing
- Not allow any visitor to behave inappropriately or stay longer than reasonable

12.2 Child Safety

When small children occupy the property, you undertake to provide all suitable childproofing safety equipment.

12.3 Cleaning Products

You must:
- Use any cleaning products strictly in accordance with instructions
- Keep cleaning products out of reach of children
- We accept no liability for misuse of products supplied

12.4 Indemnity

You indemnify us and will keep us indemnified on demand for all claims, liabilities, losses, costs and expenses (including reasonable legal fees) incurred or suffered by us in connection with:

- This Agreement, or
- Any use or misuse of the property by you or your party

Exception: We will not claim indemnity for personal injury or death caused by our act or omission.

13. HEALTH AND SAFETY

13.1 Safe Conduct

We want your stay to be as comfortable and safe as possible. Failure to comply with these conditions may be considered a breach of contract and may result in you being asked to leave.

13.2 Property Condition

You must keep the property free of hazardous objects and substances at all times and must not leave it in a condition that would be unsafe for our housekeepers, staff, visitors or guests themselves.

14. DATA PROTECTION AND PRIVACY

We will collect and process personal data about you and members of your party for the purposes of:

- Managing your booking
- Providing accommodation and associated services
- Complying with legal obligations
- Legitimate business purposes

We process such data in accordance with applicable data protection law (including UK GDPR and the Data Protection Act 2018). Where you book via an online travel agent or platform (such as eviivo), their privacy policy will also apply to their processing of your data.

Your rights:
- You have the right to request a copy of your personal data at any time
- Further information about how we handle personal data is available in our privacy notice or on request

15. COMPLAINTS PROCEDURE

15.1 Initial Contact

All complaints should be notified to us as soon as possible using:

- The contact details provided in your Booking Confirmation
- The booking platform messaging system (e.g., eviivo)

We will do our best to resolve the issue in a timely manner.

15.2 Formal Escalation

If you are still not satisfied within 14 days of the end of your stay, put your comments in writing to us, and we will use all reasonable efforts to resolve the matter as quickly as possible.

15.3 OTA Escalation

You may also raise issues via the online travel agent or booking platform through which you made your reservation, in line with their procedures.

16. LAW AND JURISDICTION

This agreement and all matters arising from it are governed by the law of England and Wales. In the event of a dispute, you will be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory law in your country of residence provides otherwise.

17. SEVERANCE

If any provision (or part-provision) in these terms and conditions becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the relevant provision shall be deleted. Any such modification or deletion shall not affect the validity and enforceability of the rest of this agreement.

18. INTERPRETATION AND DEFINITIONS

In this Agreement, the following words and phrases have the following meanings unless the context otherwise requires:

"Additional Charge" A charge or fee additional to the rental, including those specified as "Additional Charges" in these terms or in your Booking, and any other reasonable charge or fee incurred by you under these terms and conditions including but not limited to smoking fee, pet fee, locksmith charges, call-out fees.

"Owner", "we", "us" The accommodation provider offering serviced properties on a short-term basis.

"Client" The person who arranges the accommodation; could also be the guest.

"Guest", "you", "your" Any adult authorised by us to reside at the property; could also be the client.

"Property" or "Apartment" An accommodation unit owned and managed by the Owner.

"Booking" Your offer to us to hire one of our properties on the terms of this agreement, following your provision of sufficient information to enable us to complete our online or provisional booking process.

"Booking Confirmation" The email or message issued by us confirming your booking, including payment terms, check-in and check-out times, and applicable charges.

"Furniture and appliances" Furniture, appliances and other items usually found within the property and any other items the Owner agrees to provide.

"Inclusive Services" Cleaning at regular intervals (typically weekly), linen and towel provision and changes, and use of utilities (electricity, water, gas, internet) subject to fair usage policy, as stated in your Booking Confirmation.

PET ADDENDUM

This Pet Addendum is agreed between the Owner (accommodation provider) and the Guest, permitting the Guest to bring an approved pet to the accommodation, subject to the terms and conditions of the main Terms and Conditions of Hire and this Pet Addendum.

Pet Conditions and Requirements

1. Pet Fee

Guest will pay an additional pet fee of £20 per night per pet (or as stated in your Booking Confirmation).

2. Pet Health and Safety

All pets must comply with the following specifications. Documentation from an accredited veterinarian must be provided upon request:

- Pets must not exceed 30 lbs (13.6 kg) in weight
- All pets must be up-to-date on rabies vaccinations and all other required vaccinations
- Heartworm prevention is highly recommended
- All pets must be treated with appropriate flea and tick repellent (such as Advantage or similar) within 3 days prior to arrival

Fleas and ticks can cause harmful or fatal illness to humans and pets and are the sole responsibility of the pet owner.

3. Behaviour and Conduct

- All pets must be leashed or confined at all times
- Pet owners are responsible for cleaning up any and all pet waste immediately
- Pets are not allowed on furniture at any time
- Excessive barking, howling or other noise nuisances will result in termination of pet permission and removal of the pet
- Any aggression towards staff or guests will result in immediate removal of the pet and loss of all fees paid

4. Damage and Cleaning Liability

- Any evidence of pets on furniture may incur extra cleaning fees
- Guest is liable for any damage caused by the pet, including damage to carpets, furniture, fixtures and fittings
- At the end of the stay, the pet area must be thoroughly cleaned by the guest or additional cleaning charges will be assessed

5. Liability and Indemnity

- We assume no responsibility for illness, injury or death that humans or pets may incur while on the premises, unless it results from an act or omission on our part
- Guest indemnifies and holds the Owner harmless from any liability arising from the presence of the pet in the property

6. Termination of Pet Permission

- The Owner may terminate pet permission at any time if the guest fails to comply with the terms of this Pet Addendum or the main Terms and Conditions of Hire
- Breach of any pet condition may result in immediate removal of the pet and forfeiture of all payment without refund
